Terms of Service

1. Acceptance of Terms

These terms govern your use of boon.ink (the public site) and app.boon.ink (the Boon product, together "Boon"), operated by Brainy Circles OÜ, a company registered in the Republic of Estonia (registry code 17226352). By creating an account or otherwise using Boon, you agree to these terms. If you do not agree, do not use Boon.

2. Eligibility

You must be at least 16 years old to use Boon. By creating an account, you confirm that you meet this requirement and have the legal capacity to enter into this agreement.

3. Open Beta

Boon is in open beta. Anyone can sign up for free. While Boon is in beta, features, limits, credit amounts and prices may change, and parts of the product may be unavailable or behave differently than described on the site. We will tell you about changes that affect what you pay before they apply to you.

4. Accounts

• You can sign up with an email address and password, or with your Google account.
• You are responsible for keeping your credentials secure and for all activity under your account.
• You must provide accurate information when registering.
• One person, one account.
• Tell us right away at ron@brainycircles.com if you suspect someone else has accessed your account.

5. The Service

Boon suggests, pairs and identifies typefaces, and shows licensing information for them, based on the briefs you type and the images you upload. It draws on a catalog built from Google Fonts, Adobe Fonts, Envato and independent foundries. Boon also publishes free font collections ("picks"), many of them from Font Brainy posts on Instagram, with downloads where a font's licence allows it.

Replies, suggestions, pairings and detections are generated automatically, including by AI models, and may be incomplete, outdated or wrong. Boon's output is not professional design, legal or licensing advice. Use your own judgment before shipping anything based on it.

6. Credits

• Asking Boon costs credits: a suggestion or a pairing costs 1, a detection costs 3. Browsing, picks and free downloads cost nothing.
• New accounts get free credits to start. While we test what works best, the number of starting credits may differ from one new account to another.
• Every account gets 5 free credits a day. They refill at midnight UTC and do not add up from one day to the next.
• Credits are not money. They have no cash value and cannot be sold, transferred, refunded or exchanged for money.
• We may change credit amounts and costs during the beta. Credits already given to you as a gift or bonus are not taken away by such a change.
• We may remove credits gained through abuse, such as duplicate accounts or self-referral.

7. Founding Membership

The founding membership is a paid plan that adds 600 credits every membership month. It is available to buy at app.boon.ink, and these terms apply to it:

• It is billed monthly or yearly, at the price shown at checkout, including any tax.
• Payments are handled by Stripe, which acts as the merchant of record: it charges you, collects any VAT or sales tax, sends your receipts and handles payment support.
• The monthly allowance arrives at the start of each membership month. Unused plan credits do not carry over to the next month.
• Your founding price stays the same for as long as your membership stays active.
• You can cancel at any time. Your membership then runs until the end of the period you already paid for, and your account returns to the free plan.

Nothing in this section limits the rights you have as a consumer under the law of your country of residence.

8. Partner Programme

Anyone with a Boon account can invite friends, and approved partners earn a share of what the people they bring pay. How it works is explained on the Partners page, and the rules that govern it are the Partner Terms, which apply in addition to these terms.

9. Font Licensing

Boon shows licensing information (for example, whether a typeface is free to use, needs a commercial licence, or comes from a specific marketplace) as a convenience and to the best of its knowledge. Boon does not itself sell, issue or warrant any font licence.A licence for a typeface is a matter between you and its foundry, distributor or platform (such as Google Fonts, Adobe Fonts or Envato Elements), under that party's own licence terms. This applies to fonts you download through Boon too: each one stays under its own licence. You are responsible for checking the licence and getting any rights you need before commercial use. Brainy Circles OÜ is not liable for licensing information that is out of date or inaccurate. Always confirm with the original source before shipping.

10. Links to Other Sites and Affiliate Links

Boon links to font sources such as Google Fonts, Adobe Fonts and Envato. Some of these links may be affiliate links, which means we may earn a commission if you buy or subscribe after following one. It never changes the price you pay, and it does not decide which fonts Boon suggests. We route these links through our own address so we can count clicks. Other sites have their own terms and privacy policies, and we are not responsible for them.

11. Your Content and Uploads

You keep the rights to the briefs you write and the images you upload. You give us permission to process them to run Boon for you, as described in our Privacy Policy. Only upload images you have the right to share.

12. Acceptable Use

• Do not scrape, reverse-engineer or systematically extract Boon's catalog, suggestions or underlying models.
• Do not create multiple accounts or fake referrals to collect credits or rewards.
• Do not try to bypass security measures, rate limits, credit limits or access controls.
• Do not send or upload anything unlawful, infringing, or that you do not have the right to share.
• Do not use Boon for any unlawful purpose.

We may suspend or close accounts that break this section, with or without notice.

13. Intellectual Property

Boon's brand, product, catalog structure, ranking technology and site content belong to Brainy Circles OÜ. The typefaces in Boon remain the property of their foundries and rights holders. Nothing in these terms gives you rights to a typeface beyond what its own licence allows.

14. Feedback

If you send us feedback, bug reports or suggestions, you grant Brainy Circles OÜ a royalty-free, worldwide right to use them to improve Boon, with no obligation to pay you.

15. Termination

We may suspend or close your account at any time if you break these terms, or for legal, security or fraud reasons, with or without notice. You can stop using Boon at any time and ask us to delete your account by emailing ron@brainycircles.com. If you have an active founding membership, cancel it first so you are not billed again.

16. Disclaimers

Boon is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted access, or that suggestions, detections or licensing information will be accurate or complete.

17. Limitation of Liability

To the maximum extent permitted by law, Brainy Circles OÜ, its directors, employees and contractors are not liable for any indirect, incidental, consequential, special or exemplary damages arising from your use of Boon. Our total liability for any claim arising out of or relating to these terms or Boon will not exceed the greater of (a) the total amount you paid for Boon in the 12 months before the claim, or (b) EUR 100.

Nothing in this section limits liability that cannot be excluded under applicable law, including consumer protection law and liability for gross negligence or willful misconduct.

18. Changes to Terms

We may update these terms as Boon changes. Material changes will be announced on the site or by email at least 14 days before they take effect. Continuing to use Boon after that date means you accept them. If you do not accept the new terms, you can stop using Boon and ask us to delete your data before they take effect.

19. Governing Law and Disputes

These terms are governed by the laws of the Republic of Estonia, without regard to its conflict-of-laws rules. Disputes will be resolved in the courts of Tallinn, Estonia. Nothing in this section takes away the protection of mandatory consumer law in your country of residence if you are an EU consumer.
